Using any music in vids is classed as stealing unless you buy the riguts off a site called jamendo like I said ;-)

I was recently tasked with uploading all the videos from our open house onto Youtube so we could share them in our closed facebook group. Every video was "flagged for third party content". I began researching to figure out how this would affect my account. Also, all the videos were marked unlisted. I chose to acknowledge that there was third party content because using the entire song didn't fall within the guidelines of "fair use", I live in Canada and the rules seem to be different here. All it means is that the person who owns the copyright to the music now will be the one making money off your video, if it happens to go viral. I'm not sure if you get a percentage...or if they take everything. If the copyright holder is fine with you using the song they will keep the video up but it can't be played on mobile (which is what happened to all of mine). The videos are up as of now, but if the copyright holder decides a year from now they don't like them, they can be removed without notice and I will get a flag on my account. 🙁 The "Content ID" software is unbeatable, copyright owners submit their work and if it ever matches something uploaded it will be flagged. Apparently it scans 100 years of video everyday, it's insane! I've thought about reaching out to Bruno Mars via twitter to ask if I can use his song....I doubt he would mind!!! 😉 Thanks for all the great info ladies.
So how exactly do you find out which songs you can and can not use?
If there's a copyright issue youtube will find it whether they're public or unlisted. I recommended to keep them unlisted if you want to make a test, but that's only so that no one else start watching the vids until you're sure you still want to keep them. Maybe you don't mind but I usually prefer that no one sees the before I've made up my mind.
So generally when I get these notices, it just says that my video won't be able to be viewed in certain countries (usually Germany). If it includes Canada in the list, then I usually will change the music in the video and re-upload it (deleting the first one that was flagged), but if it just lists Germany or a couple countries, I don't bother. My question is: does anyone ever hit the "acknowledge" or "dispute" buttons? I generally don't click on either because I don't know what the dispute button will get me into, but I also don't want to seem like I'm admitting to any sort of guilt by hitting acknowledge. Just thought I'd see what anyone else had to say!

@LolaSlaytor, I've hit the acknowledge button on all my videos, because it doesn't matter if you acknowledge or dispute it, the Content ID software as already flagged your video as having copyright material. If you don't click either I'm not sure what happens...do you notice your videos unable to be viewed on mobile even if you have hit either button? My thoughts were that, I'm not going to deny it, cause we're all using music in our pole videos. By acknowledging that, all I've down is given the copyright holder the option to take down my video if they want to, OR, if it starts to get millions of view, get the revenue from it. Since all my videos are unlisted I doubt I'm going to become Youtube famous anytime soon. I'm hoping the very minimal views of my videos means no one will care!!
@jbcabby - that's a good point! I've never hit either button so I'm not sure if it will affect what can and can't be viewed on a mobile device (although I doubt it will have any effect). Some of my videos can't be viewed on mobile devices, it's annoying but better than having them taken down completely! Also noticed you're in Toronto! I'm from Hamilton - what studio do you dance at? Maybe we've already met somewhere before?

@LolaSlaytor I was actually thinking that cause I was in Hamilton for vertical love in the summer! I didn't perform, just went to watch. I'm at Aradia Fitness Toronto.
I tried the acknowledge-button, since I'm struggling with these issues right now. It didn't seem to change anything. My vid was disabled on mobile devices both before and after acknowledging :(.
Maybe this should be the inspiration for a new StudioVeena.com challenge: Dance to silence. (I'm only half joking. When I was in colorguard in high school there was another team who did an entirely silent performance that was pretty breathtaking.) Classical, traditional and some old folk music (like nursery rhymes, hymns & gospel, etc.) tend to be public domain, might be time to start expanding our tastes... I mostly kid. Nearly all of my videos only live on StudioVeena, mostly because the only people I care to show my videos to are already here. In the past I've occasionally gotten warning emails from YouTube about copyrighted content but they've never taken a video down or flagged my account or anything, just said "Hey, just so you know, WE SEE WHAT YOU DID THERE." Those notifications are there for legal purposes so that if/when ASCAP takes one of us to court, we can't claim ignorance of copyright law. (That's what the 'Acknowledge' button is about too.) And in addition to collecting the all-important $$ on the music rights, some artists also really care how their music is presented. Some presidential campaigns have used songs for their ads and events without the songwriter/artist's permission, and were met with pretty harsh Cease and Desist notices from those artists, not just over money, but because they didn't like the use of their song for politics or for that candidate's party/campaign (I think Bruce Springsteen was one). Hypothetically there are artists out there too who would not be thrilled at their songs being publicly used for pole dance performances, no matter the incredible justice we do those songs through our art.
Dance to silence - Not a bad idea haha! Some groups I've used a few songs to and I just hope they don't think I'm mistreating their music!

My main issue with Youtube is that it IS making me dance to silence. Once a video is flagged for copyright it removes my audio. This is my only concern. I just want to dance to the music I was dancing to. I am very upset that charlee wagner's winning performance and literally hundereds of other dancers, pole, aerial, or grounded can dance to it, but I cannot. I am upset that Skin is flagged, I am upset that Wicked Games is flagged. And then all of my videos are silent. Dance is music + personal emotion through the form of physical expression. If you take away the music, half or more than half of the message is lost!

I haven't tried it but one comment from 3 weeks ago said it helped. There are other comments saying it didn't work but I don't know if they applied the update or not.
CapFeb: I understand you to 100%. Dance to silence would be a one time thing, then enough... It's just a little strange because my audio has never been removed. My vids have just been blocked in certain countries or on mobile devices. Several times. But the audio track has always stayed. Also I think it's weird if people can perform to pieces that they mute for you. I don't know if it could have something to do with from which country it's uploaded. Just guessing wildly now because I don't have a clue.
It's not really YouTube's fault or decision here. If you're going to be annoyed with anyone, it would be the recording companies, studios and licensing agents who are so strict and contradictory about the use of their material. YouTube is complying out of legal obligation to cover its ass. Honestly if ASCAP, BMI etc. knew that we post content royalty-free on StudioVeena, they'd be after Veena & Webby too, and after us. We can get away with it here because we're small fry. YouTube definitely isn't. Blocking in certain countries usually means the song/artist/record label isn't copyright-protected under those countries' laws. Like, American or Canadian copyright law might not translate over to Germany so they just block it from German viewers. No one is being targeted by YouTube for being a certain kind of performer; the system is automatic. We don't know what rights Charlee Wagner or pole competition organizers or whomever have purchased, or it could be that they're still breaking the rules but just didn't get caught for some reason. It's not YouTube favoritism or bias, and it's definitely an imperfect system. Anyone using YouTube, though, agrees to abide by YouTube's Terms of Service, which includes all this copyright nonsense. Don't like it, don't use YouTube. YouTube users can't have their cake and eat it too.
